sorry double post ;-(
In those particular images, the idea was certainly copied. But I'm not sure if stealing ideas is unfair. I'd have to think about that. After I did my little golden xmas tree, lots of people copied the idea and made similar images.
I saw that just a moment ago here:
http://www.petapixel.com/2012/01/25/create-a-similarly-composed-photo-in-the-uk-risk-copyright-infringement/?utm_source=feedburner&utm_medium=email&utm_campaign=Feed:+PetaPixel+(PetaPixel)
But what is that stolen idea? A red bus on a black and white photos? I made similar one (with Polish bus) around 10 years ago in my school. And I haven't seen the london version before.
So may be the bus and the Big Ben? But it is difficult not to make such picture in London ;-)
Does this mean that advertising agencies using meme's from Youtube and the film industry are going to get panned too? Where will this bollocks end?
This is seriously f*cked up. The judge needs sectioningl.
So we just need someone who has a proven / date stamped photo that looks similar and was taken prior to the Temple Island Collection Ltd one and we can have another court case. Hmmm, I think I may have one from when I were a lad. Granted, it's a horse drawn carrage and the Houses of Parliment are still under constuction, oh and I had to paint it red, but the idea is the same !
Come on guys, get a life, nothing is original, your just money grabbing little ........
I think most of the laws around the world are clear enough.
Ideas can not be copyrighted, that is what patents are for.
Copyright and I think patents do not apply to clothes and similair because they are considered to utilitarian:

(this is something you should watch anyway !)
There is something which is fairly new which is called a Community Design:
http://en.wikipedia.org/wiki/Community_design
Which is specifically meant to prevent counterfeiting of designs (the video talks about that too).
If you take the existing image and create a derived work that would be a totally different story.
